About these Terms

These Terms & Conditions govern your use of the Erthiq website located at erthiq.in (the "Site") and any services provided through it by Erthiq Farm LLP, a limited liability partnership registered in Kerala, India, with GSTIN 32AAMFE2725N1ZA ("Erthiq", "we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The date of the most recent revision is shown at the top of this page.

Use of the Site

The Site is provided for informational and commercial purposes related to Erthiq's spice trade platform and estate programme. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of any third party. You must not attempt to gain unauthorised access to any part of the Site or its underlying systems.

All content on the Site — including text, images, data, and design — is the property of Erthiq Farm LLP or its licensors. Reproduction, redistribution, or commercial use of any Site content without our prior written consent is prohibited.

Trade Platform (ETP)

The Erthiq Trade Platform ("ETP") facilitates wholesale purchase of spices directly from our estate. Access is subject to KYC verification and approval by Erthiq. All transactions on the platform are governed by the order terms agreed at the time of purchase, including price, grade, quantity, and dispatch timelines.

Erthiq does not act as a broker or agent for any third party. All stock sold through ETP is farm-owned. Grade descriptions are provided in good faith based on on-site sorting; minor variations are inherent in agricultural products and do not constitute a defect unless they materially differ from the stated specification.

Payment terms, refund conditions, and dispute resolution procedures are set out in the platform's operational policies, which are incorporated by reference into these Terms.

Estate Programme

The estate participation programme described on this Site is an agricultural land-based arrangement. It is not a collective investment scheme, a financial product, or a regulated investment under the Securities and Exchange Board of India (SEBI) Act or any other applicable financial regulation. Erthiq does not offer, promise, or imply any specific monetary gain, crop-based payout, or financial outcome to participants.

All participation models (Fractional Lease, Acre Lease, and Buy Plantation) are governed by formal agreements executed under applicable Indian contract and land law. Participants are strongly advised to seek independent legal and financial advice before entering any arrangement. Agricultural land acquisition is subject to land ceiling laws, state regulations, and, for non-resident Indians, the Foreign Exchange Management Act (FEMA).

Crop output figures published on the Site are historical reference data only and do not constitute a guarantee of any specific production level. Actual output varies with weather, plant health, and other agricultural factors outside our control.

Governing Law

These Terms are governed by and construed in accordance with the laws of India, with jurisdiction vested in the courts of Ernakulam, Kerala. Any dispute arising out of or in connection with the use of this Site or any arrangement with Erthiq shall be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala, India, unless otherwise agreed in writing.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
